China-Africa Dispute Settlement – The Law, Economics and Culture of Arbitration
Won Kidane
Wolters Kluwer, 2011

This book examines the rapid rise of China-Africa trade—from $10 million in the 1980s to over $100 billion by 2009—and the lack of effective dispute resolution systems. It reviews WTO mechanisms, treaties, and arbitral institutions like ICSID, ICC, LCIA, and CIETAC. Kidane advocates institutional arbitration and proposes a framework addressing legal, cultural, and economic challenges to ensure fair dispute resolution.

The Culture of International Arbitration
Won L. Kidane
Oxford University Press, 2017

This book examines the overlooked role of culture in international arbitration, where parties and arbitrators often come from diverse legal traditions. It defines “legal culture” and explores how cultural miscommunication can affect fairness, efficiency, and legitimacy.

The book reviews historical court-tribunal relations, cultural differences in fact-finding, and insights from leading jurists. Kidane argues for cultural competence among arbitrators to prevent bias and improve outcomes.

Africa’s International Investment Law Regimes
Won L. Kidane
Oxford University Press, 2024

This book examines Africa’s complex relationship with ICSID. Although Africa attracts less than 4% of global FDI, it accounts for nearly a quarter of ICSID cases. Kidane analyzes 30+ cases and treaty activity, finding little systemic bias but highlighting Africa’s push for fairness and representation. The work explores reforms at continental, regional, and bilateral levels, emphasizing Africa’s evolving role in shaping international investment law and investor–state dispute settlement.

Arbitrating the Conduct of International Investors
Jose Daniel Amado, Jackson Shaw Kern, Martin Doe Rodriguez
Cambridge University Press, 2018

This book traces the evolution of investment arbitration and its drift from the reciprocal vision of its founders. It offers tools to enhance host States’ and nationals’ access to dispute resolution and proposes model texts to restore fairness and mutuality. A key resource for scholars, policymakers, and practitioners shaping the future of international investment law.

ARBITRATION
Law Over Borders Comparative Guide 2025

Ethiopia’s Arbitration and Conciliation Working Procedure Proclamation No. 1237/2021 aligns with UNCITRAL, limits court interference, allows interim measures, and regulates arbitration centers. Strengths include international alignment and enforceability, while challenges are broad non-arbitrability, strict formalities, and Ministry oversight. Ethiopia ratified the New York Convention in 2020, enhancing arbitration for commercial disputes.
